Acceptance of these terms

By using securethefunding.com you agree to these terms. If you do not agree with them, please do not use the site. We may update them, and the date at the top of this page tells you when they last changed; continuing to use the site after a change means you accept the revised terms.

Who you are dealing with

This site is operated by Secure The Funding, LLC, a Licensed Mortgage Brokerage Business regulated by the Florida Office of Financial Regulation, NMLS #2085021, at 15715 S Dixie Hwy, Suite 417, Palmetto Bay, FL 33157. We are a mortgage broker. We arrange loans; we do not make them, and we do not make credit decisions.

Nothing here is an offer of credit

No page on this site is a commitment to lend, an offer or extension of credit, an approval, a rate lock, or an advertisement of specific loan terms. Loan programs, rates, fees, eligibility rules and availability are set by third-party lenders and by government agencies, and they change frequently and without notice.

Nothing on this site is legal, tax, accounting or investment advice. Speak to your own professional adviser before acting on anything you read here.

Calculators and estimates

The calculators are illustrations, not quotes. They run entirely in your browser using figures that you supply, and they do not know your credit, your property, your lender or the day you lock. Their published methodology sets out every assumption they make. Real figures come from a licensed loan officer after review of your actual file, and they will differ.

Where we can help you

We originate loans secured by property located in Florida only. Nothing on this site is an offer to lend, or a solicitation to borrow, in any other state. You must be at least 18 and legally able to enter a contract.

Your side of the bargain

Give us accurate information — a loan decision built on inaccurate information helps nobody, and misstating facts on a mortgage application is a federal offence. Do not use this site unlawfully, do not try to interfere with it or gain unauthorised access to it, do not scrape it for a competing service, and do not submit anyone else's personal information without their permission.

Our content

The text, design, calculators, code and graphics on this site belong to Secure The Funding, LLC or to our licensors, except for third-party marks used to identify loan programs. You may read, print and share pages for your own non-commercial use. You may not republish, sell or build a competing product from them without written permission.

Third-party services and links

Booking and enquiry forms on this site are served by GoHighLevel, and information you enter into them goes to GoHighLevel rather than to this website. The contact page embeds a Google map, and every page loads fonts from Google. Those providers receive your IP address as a normal part of serving the request, and their own terms and privacy policies govern what they do with it.

We link to third-party sites such as NMLS Consumer Access, government agencies and review platforms. We do not control them and we are not responsible for their content or their privacy practices.

Contacting you

If you give us your phone number or email address, you are asking us to reply, and you agree that we may contact you about your enquiry using the details you provided. Message and data rates may apply. You can tell us to stop at any time by replying STOP to a text, using the unsubscribe link in an email, or calling (786) 519-3007. Consent to marketing contact is never a condition of getting a loan.

Privacy

How we handle your information is set out in our privacy policy, which forms part of these terms.

Disclaimer of warranties

This site is provided “as is”. We work to keep it accurate and available, but we do not warrant that it will be uninterrupted or error-free, that defects will be corrected, or that every figure and program detail is current at the moment you read it. To the fullest extent permitted by Florida law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability

To the fullest extent permitted by Florida law, Secure The Funding, LLC and its members, officers and employees are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost opportunity, arising out of your use of this site — including reliance on any calculator output or program description. Nothing here limits liability that cannot be limited by law.

This limitation concerns your use of the website. It does not alter the duties we owe you as your mortgage broker once you engage us, which are governed by your loan documents and by Florida and federal mortgage law.

Indemnity

You agree to indemnify Secure The Funding, LLC against claims, losses and reasonable legal fees arising from your misuse of this site, your breach of these terms, or your submission of information you had no right to submit.

Governing law, and where disputes are heard

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising out of the site or these terms will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you and we each consent to the jurisdiction of those courts.

There is no arbitration clause in these terms, and no class-action waiver. If we end up in a dispute, either of us may bring it before a court, and neither of us gives up the right to a jury trial.

If part of this is unenforceable

If a court finds any provision of these terms unenforceable, that provision is limited or removed to the minimum extent necessary and the rest stays in force. If we do not enforce a provision on one occasion, we have not given up the right to enforce it later.
